How long do I have?

Three years from the date of the accident in most cases. For a child, until their 21st birthday. There is no limit where someone lacks the capacity to claim. Evidence disappears faster than the deadline arrives, so it is worth starting the conversation early.

What does it cost me?

Typically, you must file a claim within three years of your bicycle accident, unless you are claiming on behalf of a child or a family member unable to claim due to mental incapacity.

  • For children, claims can be made at any time before they turn 18, or within a three-year window after their 18th birthday.
  • There is no time restriction if you are representing someone who lacks the mental capacity to claim.
  • If filing for a loved one who died as a result of the accident, the claim must be made within three years of their death, or of receiving their post-mortem results.

There is no fixed sum you can claim for a bicycle accident. Your compensation will be determined by the severity of your injuries and the financial impact of the accident. Once we assess the details of your incident, the solicitor acting on your case will advise you on the compensation you may receive.

When evaluating your compensation, we consider:

  • The extent of your injuries
  • Expenses for current and future medical treatment, including provision for lifelong care if necessary
  • Lost income due to time off work or an inability to return to it
  • Costs of adapting your home or vehicle as a result of your injury
  • Damage to your bicycle and other property such as helmets, clothing, phones and laptops

The time it takes to receive your compensation depends on several factors:

  • Establishing liability for your injury
  • Whether the other party accepts responsibility, and how quickly they do so
  • The severity of your injuries, and how long it takes to establish your treatment and rehabilitation needs

In most cases we can speed the process up by reaching a settlement outside court, which is quicker than litigation. We may also secure interim payments ahead of the final resolution, which can help with lost earnings, expenses, medical bills and travel costs.

Yes. If you have been injured in a cycling accident and the other vehicle either left the scene or was uninsured, we can help you pursue a bicycle accident claim through the Motor Insurers' Bureau.

This covers accidents where the other vehicle or driver cannot be traced, as well as those where the driver is uninsured. You generally have three years from the date of your accident to start a claim. If the incident involved a severe head or brain injury and someone is claiming on your behalf, you may have longer.

No. We work on the basis of a Conditional Fee Agreement, better known as No Win, No Fee. If we do not win your case, you are not obliged to cover our fees.

There may be additional expenses known as disbursements, which can include fees for medical reports, the cost of legal representation in court such as a barrister, and expert witness or accident report fees. These are typically covered by the defendant. If a case is unsuccessful you may technically be responsible for the defendant's costs, which is why an After the Event insurance policy is arranged to protect you from those expenses.

Yes. There is no law in the UK requiring an adult cyclist to wear a helmet, and not wearing one does not prevent you from claiming.

An insurer may argue that a helmet would have reduced a head injury, which can reduce an award for that specific injury. It does not affect liability for the accident itself, and it has no bearing at all on claims for other injuries, your bike, your kit or your lost earnings. Tell us the position honestly at the outset and we will deal with the argument if it is raised.
